India’s top court questions Delhi’s gendered teaching-job notices

Authorities must explain the rules behind male-female vacancy notices and how transgender applicants will be accommodated.

India’s Supreme Court has asked Delhi authorities to explain why teaching vacancies are divided between male and female applicants, and how transgender people will be accommodated in public employment.

Justices J.B. Pardiwala and K. Vinod Chandran set out the questions in a 16 October order in Jane Kaushik’s case and a connected petition. The petitions remain undecided.

In an earlier order on 10 April, the court allowed Kaushik to apply for vacancies under the transgender category regardless of the gender stated in the notice. It repeated permission previously given by the Delhi High Court.

The October order asks whether the authorities propose to include a third gender in vacancy notices. It also asks which rules authorise the Delhi Subordinate Services Selection Board to advertise teaching jobs.

If those rules require separate male and female notices, the authorities must explain the basis for using gender. If they do not, the court wants to know the purpose of dividing vacancies that way.

The respondents must file affidavits within 15 days of the October order and share them with the petitioners, who can respond before the next hearing. Both matters are listed for 19 November.
