The eight men were aged from 20 to 40 and were engaging in homosexual group sex before being discovered by police naked in a hotel room, Xuhui District People's Court said yesterday according to Shanghai Daily.
The group organizer, surnamed Wu, is a married man with a doctorate who had a child with his wife, the documents said. He began by posting information via QQ, an online chatting tool, to seek a gathering of gays in September. After vetting the men via video chats, Wu invited them to the hotel.
On September 7, Wu booked a hotel room in Xuhui District and told the others. Wu played gay porn videos on his laptop whilst he waited. When the others arrived, they had a bath and had sex until the arrival of police, who had received a report about the meeting.
The only other information given was that most of the men were well-educated. The court said that two had doctorates and four had master's degrees or were graduate students. Some were married. Two came to Shanghai specifically for the orgy.
Wu was sentenced to five months of administrative detention, which is less serious than jail time, for organizing and engaging in the group sex. The others did not get detention but were given administrative penalties that were not disclosed for engaging in group sex.
In Nanjing in 2010 a gay orgy sparked an investigation into ‘homosexual licentiousness’ in which nearly a dozen were questioned.

prior to the 1960's in the U.S. were married but engaging in
private gay sex and it's still going on. However, this story just
shows you where the Chinese government and society are on
gay issues "still in the Dark Ages". What I really find stupid is
posting on QQ that you want to engage in an all male orgy.
The government monitors websites in China by all accounts.

While we can condemn the existence of the law itself, the sentence is actually quite lenient - the authorities have issued life sentences or even suspended death sentences for cases of "group licentiousness" in the past.
Unfortunately the answer is yes, if a country is run by a conservative-hypocrite closed minded-religiously & culturally strict-draconian law based government, like many Middle Eastern countries such as Saudi Arabia, Iran & Egypt; Asian countries with strong traditional cultural values like China; and also in third world & developing nations in South East Asia especially in those restrictive Muslim dominant population such as Indonesia, Malaysia & Brunei Darussalam.
This will definitely change if orgy and homosexuality are no longer perceived and labelled as 'sexual deviant', and also if accepted and 'normalized' by society and the authorities concerned.
Only time will tell...
